Terms of Service

1. Acceptance of Terms

By creating an account or using Postida ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Postida is a social media content tool for HVAC and home services businesses. The Service lets you browse professional content, generate AI-assisted captions and images, and publish or schedule posts to your connected social media accounts.

We do not guarantee that content published through the Service will achieve specific marketing results, reach, or engagement.

3. Account Responsibilities

You are responsible for:

• Keeping your login credentials secure and preventing unauthorized access to your account.
• All activity that happens under your account.
• Making sure any social media accounts you connect belong to you or a business you are authorized to manage.
• Reviewing all AI-generated content before publishing. You are responsible for the accuracy and appropriateness of anything published through your account.
• Following all applicable laws and regulations when using the Service.

4. Acceptable Use

You may use Postida to create and publish social media content for legitimate business promotion. You may not:

• Post spam, misleading claims, false advertising, or content that violates any social media platform's rules.
• Generate or publish content that is illegal, defamatory, harassing, threatening, or harmful.
• Scrape, crawl, or extract data from the platform in any automated way.
• Abuse the system with excessive or scripted requests beyond normal usage.
• Resell or provide access to the Service to others without our written consent.
• Interfere with or disrupt the Service or its systems.

5. AI-Generated Content

Content generated by the AI tools in Postida is a starting point for your review. You agree that:

• AI-generated content may sometimes be inaccurate or unsuitable. Always review before publishing.
• You are responsible for any claims made in posts you publish, including pricing, services, warranties, or certifications.
• Generated images are licensed for use in your business social media only. You may not resell or redistribute them as standalone assets.
• We make no guarantees about the originality, copyright status, or fitness for commercial use of AI-generated content. You use it at your own risk.

6. Social Media Integrations

The publishing features of Postida rely on third-party social media platforms. You agree that:

• We have no control over third-party platforms, their policies, or their availability. We cannot guarantee publishing will succeed at all times.
• Your use of connected social accounts is subject to that platform's own Terms of Service. Any restrictions or suspensions placed on your accounts by the platform are your responsibility.
• Third-party platforms may change or restrict their services at any time. We are not responsible for disruptions caused by these changes.
• We cannot guarantee that scheduled posts will always be delivered successfully. Failures caused by third-party services are outside our control.
• Access tokens expire periodically. If your token expires before a scheduled post, that post may fail. You are responsible for keeping your accounts connected.

By connecting a social account, you authorize Postida to publish content on your behalf based on your actions. You can revoke access at any time from the Connections page or through your platform's settings.

7. Subscriptions and Billing

Paid plans are billed monthly on a recurring basis. By subscribing, you authorize us to charge your payment method each billing cycle until you cancel.

• You can cancel anytime from the Billing page. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at support@appdore.com within 7 days.
• Unused monthly credits do not roll over.
• We may change plan pricing with at least 30 days notice. You can cancel before the change takes effect if you disagree.
• Payments are processed through Stripe. We do not store your credit card details.

8. Free Plan

Free plan users receive limited access to AI generation credits, social account connections, posting, and the content feed. We may change free plan features and limits at any time with reasonable notice.

9. Account Termination

We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or are used for fraud. Serious violations may result in termination without prior notice.

You can delete your own account at any time from Account Settings. Your data will be handled as described in our Privacy Policy.

10. Service Availability

Postida is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We are not liable for losses caused by downtime, failed posts, or third-party service disruptions.

11. Limitation of Liability

To the maximum extent allowed by law, Postida and its operators are not liable for any indirect, incidental, special, or consequential damages from your use of the Service, including lost revenue, lost data, damage to business reputation, or actions taken by third-party platforms.

Our total liability for any claim shall not exceed the amount you paid us in the three months before the event.

12. Indemnification

You agree to defend and hold harmless Postida and its operators from any claims, damages, or expenses arising from your use of the Service, content you publish, or your violation of these Terms or any third-party policies.

13. Intellectual Property

The Postida platform, including its software, design, and content library, is our property and protected by intellectual property laws. You may not copy, modify, or create derivative works from the platform without written permission.

Content you generate or customize is yours to use for your business social media, subject to the limits in Section 5.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use after changes take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States. Any disputes shall be subject to the exclusive jurisdiction of courts located in Texas.
